Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Sundae LLC (“Moonlight,” “we,” “us”) governing your use of the Moonlight application and related services. By creating an account or using Moonlight, you agree to these Terms. If you do not agree, do not use the service.

You must be at least 13 years old and have the authority to enter into these Terms. If you use Moonlight on behalf of a business, you represent that you have the authority to bind that business to these Terms.

You sign in via Google OAuth. You are responsible for maintaining the security of your Google account and for all activity under your Moonlight account. Notify us promptly if you suspect unauthorized access.

Moonlight connects to third-party services (currently Google Workspace) to provide its features. By connecting an integration, you grant us permission to access that service on your behalf within the scopes you authorize. You may disconnect any integration at any time from Settings.

You are responsible for ensuring you have the right to connect any account or mailbox. Do not connect accounts you do not own or are not authorized to manage.

Moonlight generates a daily briefing by analyzing data from your connected integrations using AI. The briefing may include draft replies, scheduling suggestions, and other action items. You review and approve actions before they are executed.

Moonlight acts on your behalf only when you approve. No action is taken without your explicit approval.

Briefing items, draft replies, and suggestions are generated by AI and may contain errors. You are responsible for reviewing all AI-generated content before approving it. Moonlight does not guarantee the accuracy, completeness, or appropriateness of AI-generated content.

You agree not to:

• Use Moonlight for any unlawful purpose
• Attempt to gain unauthorized access to the service or its infrastructure
• Interfere with or disrupt the service or other users’ use of it
• Connect accounts or submit content that violates third-party rights
• Use the service to send spam or unsolicited messages
• Reverse-engineer, decompile, or attempt to extract the source code of the service

Moonlight offers paid subscription tiers (Pro and Max). Free trial periods may be offered at our discretion. Subscriptions are billed monthly through Stripe. You can upgrade, downgrade, or cancel at any time from Settings.

If payment fails, your account enters a grace period. If payment is not resolved within the grace period, your account may be downgraded or restricted.

We may change pricing with 30 days’ notice. Price changes do not apply to the current billing period.

Moonlight and its original content, features, and functionality are owned by Sundae LLC and are protected by copyright and other intellectual property laws. You retain ownership of any content you provide through connected integrations.

Our Privacy Policy describes how we collect, use, and protect your data. By using Moonlight, you agree to the Privacy Policy.

We strive to keep Moonlight available but do not guarantee uninterrupted service. We may perform maintenance, updates, or changes that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

You may delete your account at any time from Settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your data is permanently deleted per our Privacy Policy.

Moonlight is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the service will be error-free, secure, or uninterrupted, or that AI-generated content will be accurate or suitable for any purpose.

To the maximum extent permitted by law, Sundae LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Sundae LLC from claims arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

We may update these Terms and will note the effective date above. Continued use of Moonlight after changes take effect constitutes acceptance. If we make material changes, we will notify you via email or an in-product notice.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
